O principal objetivo é compreender como crianças e adolescentes eram tratados quando cometiam crimes. Como opção metodológica, um processo específico foi escolhido a fim de guiar essas reflexões. Baseado nele, é possível fazer algumas afirmações sobre o Direito Penal no Império do Brasil, ainda que as diferenças regionais precisem ser consideradas. Assim, pretende-se compre-ender como a justiça operava, discutindo algumas no-ções de senso comum e fornecendo informações para um olhar crítico sobre o passado. PALAVRAS-CHAVE: Código Criminal. Menoridade. Justiça Penal. Processo Criminal. ABSTRACT: The article approaches the concept of age of criminal responsibility in the last decades of the 19th century. The main goal is understanding how children and teenagers were treated when they committed criminal offenses. For methodological purposes, a specific case was chosen to guide these reflections. Based on it, it is possible to make some statements about the Brazilian Empire’s criminal law, even though regional differences must be taken into account. The aim is, therefore, to understand how the justice system used to operate, discussing some common sense’s notions and providing some pieces of information for a critical view of the past.
