This paper addresses the specificities of international trials of gross human rights violations and how international courts
approach this issue, notably, the International Court of Justice. We discuss the importance of international trials in recognizing victims and how they can influence the construction of their memories and overcoming trauma and rebuilding social tissue. We revise how International Courts specialized in Human Rights and International Criminal Tribunals have been dealing with the matter so that we can, finally, address the International Court of Justice. In conclusion, there is a case study of the trials before the ICJ regarding violations to the genocide convention in the dissolution of the former Yugoslavia, case Bosnia vs. Former
Yugoslavia (Serbia) and Croatia VS. Serbia.
