dc.description.abstractThe intention here is to examine the criminal situation of the upper members of the entrepreneurial organization which, in the context of business activity, issues orders to a subordinated execute the action defined as crime. Will be investigated doctrinal positions about the theme, especially, authorship, co-authorship, mediated authorship and participation. At the end will be conducted an analysis of the conduct from the brazilian law, establishing a solution proposal to determine the (co)authorship of the order issuer.
