Parceria público-privada no sistema prisional: uma análise acerca do complexo penitenciário público-privado de Ribeirão das Neves/MG

The present study is dedicated to analyzing the Public-Private Penitentiary Complex (CPPP), located in Ribeirão das Neves/MG, the only Public-Private Partnership in the prison system, which has been in operation since 2013. It seeks to verify if the CPPP is an efficient model that presents itself as an alternative to the current scenario of violation of rights observed in Brazilian prisons. The analysis to assess whether the provision of prison services is sufficiently and appropriately promoted in the CPPP is based on the rights that are guaranteed to prisoners, especially those provided for in the Penal Execution Law (LEP), and in proportion to this guarantee. Still in this
efficiency parameter, the internal reality of the unit is evaluated investigating the occurrence of problems of the traditional system, such as overcrowding, insalubrity, leaks, deaths and riots. To meet the aforementioned purpose, the available structures for the execution of the sentence are analyzed and the rehabilitation programs are presented. The percentage of work and study provided in the CPPP, activities linked to the prisoner's social reintegration fronts, is also verified. The study of this percentage is based on data from the National Penitentiary Department (DEPEN) and the National Council of Justice (CNJ). Finally, the history of inspections carried out at the unit by the CNJ, from August 2014 to October 2020, as well as the complete report of the last inspection, which took place in October 2020, is examined. Having achieved these objectives, there is, in general, an environment with structure and functioning that serve the purposes of the sentence, providing the modernization and humanization of the prison system by guaranteeing almost all the rights established by the LEP.
