“Mío, tuyo, suyo” : propiedad y posesión en los Dictámenes de Vélez Sarsfield como asesor del gobierno del Estado de Buenos Aires (1854-1858)

Abstract

Resumen: El artículo se propone analizar, en los dictámenes que Dalmacio Vélez Sarsfield produjo como asesor del Estado de Buenos Aires entre los años 1854 y 1857, las concepciones en torno a los derechos sobre la tierra, en especial aquellas referidas a las nociones de posesión y propiedad, y su articulación con la política modernizante del Estado de Buenos Aires. Lejos de encontrar construcciones dogmáticas definidas se advertirá la relación estrecha de estas con la problemática que acuciaba a la campaña bonaerense y que recibieron una esmerada atención de los historiadores que se han abocado a estos temas: el avance de la frontera y la distribución de las nuevas tierras ocupadas, la situación de los enfiteutas, la preservación de los campos de pan llevar, la instalación de las municipalidades y la formación de los ejidos, la actuación del Departamento Topográfico, entre otros. Para ello se estudiarán las argumentaciones de Vélez sobre el derecho romano, indiano y patrio y la reinterpretación de esta normativa a la luz de nuevas ideas propietarias liberales. Se advertirá que, como muchos juristas contemporáneos, Vélez no manifestó una posición rupturista de la tradición jurídica anterior, sino que conceptualizó un derecho de propiedad exclusivo que empalmó con aquella.

Abstract: The article aims to analyze, in the opinions that Dalmacio Vélez Sarsfield produced as an advisor to the State of Buenos Aires between 1854 and 1857, the conceptions around the rights to land, especially those referring to the notions of possession and property, and its articulation with the modernizing policy of the State of Buenos Aires. Far from finding defined dogmatic constructions, it will be noted their close relationship with the problems that affected the Buenos Aires campaign and that they received careful attention from historians who have focused on these issues: the advance of the border and the distribution of the new ones occupied lands, the situation of the emphyteuts, the preservation of the pan llevar lands, the installation of municipalities and the formation of ejidos, the performance of the Topographic Department, among others. For this purpose, Vélez’s arguments on Roman, Indian and national law and the reinterpretation of this regulation will be studied in the light of new liberal proprietary ideas. It will be noted that, like many contemporary jurists, Vélez did not manifest a rupturist position of the previous legal tradition, but rather that he conceptualized an exclusive property right that he linked with it.
