El derecho en tiempos de crisis: una aproximación a las nociones de verdad y justicia

Abstract

Resumen: El derecho es consecuencia de la sociedad. Esta relación genera una complejidad entre lo que es justo y la sociedad; y debido a los fenómenos que se manifiestan en esa relación se sostiene la crisis del derecho. Esta reflexión se efectúa mediante el estudio teórico doctrinal de las nociones de Derecho, Justicia y Verdad, el análisis de la influencia de la política en la justicia y el derecho, el problema de las funciones negativas del derecho, el concepto de derecho injusto y la concepción Moderna de derecho subjetivo, a fin de establecer las causas principales de la crisis del derecho.

Abstract: Law is a consequence of society. This relationship generates a complexity between what is just and society; and due to the phenomena that are manifested in this relationship the crisis of law is sustained. This reflection is carried out through the theoretical doctrinal study of the notions of Law, Justice and Truth, the analysis of the influence of politics on justice and law, the problem of the negative functions of law, the concept of unjust law and the modern conception of subjective law, in order to establish the main causes of the crisis of law.
