| dc.description | Resumen: En el presente se propone el uso de un test de convencionalidad de las regulaciones normativas del derecho a la objeción de conciencia, conforme a los estándares aplicados por la Corte Interamericana de Derechos Humanos en supuestos diversos, pero que resultan analógicamente aplicables al referido Derecho Humano. En tal sentido, se defenderá la hipótesis conforme a la cual debe aplicarse un escrutinio estricto para juzgar la compatibilidad de la reglamentación del derecho a la objeción de conciencia con la Convención Americana sobre Derechos Humanos, por estar en juego criterios de discriminación expresamente prohibidos por el artículo 1.1. de la precitada Convención, además de inferirse dicho examen de los términos del artículo 12.3. | |
| dc.description | Abstract: The present article proposes the use of a conventionality test for the normative regulations of the right to conscientious objection, which is in accordance with the standards applied by the Inter-American Court of Human Rights in cases that, though different, result applicable through analogy to the aforementioned human right. In this regard, the study argues the hypothesis according to which strict scrutiny must be applied in order to judge the compatibility of the right to conscientious objection´s regulation with the American Convention on Human Rights, taking into account that, in addition to what can be inferred of article 12.3 of the aforementioned Convention, criteria of discrimination expressly prohibited by article 1.1 is involved. | |
