Reconocimiento de construcciones ilegales destinadas al uso residencial, ejecutadas en el municipio de La Estrella entre los años 1977 y 2002.

Abstract

Resumen: A partir de la voluntad de la Administración Municipal de La Estrella para responder a una necesidad sentida de su comunidad, cual es la de poder legalizar sus viviendas construidas al margen de los requisitos y de la normatividad urbanística y constructiva, se formula un Programa de Reconocimiento de Construcciones Ilegales. La formulación del Programa se desarrolla a partir de la realización de un diagnóstico, que va desde la información general del municipio, la evaluación de los antecedentes de su proceso de planeación, sus autoridades en esta materia y su desarrollo constructivo, hasta el Plan de Ordenamiento Territorial y, en particular, el análisis del uso residencial, sus tipologías y normas. Igualmente, para efectos del marco legal del programa y en consideración aIas disposiciones de superior jerarquía a las que debe someterse el municipio, se analizan las normas, leyes y decretos de orden nacional, inherentes a las licencias de construcción y al reconocimiento de construcciones. Como complemento al diagnóstico y según los resultados de la evaluación de los temas antes mencionados, se realiza una encuesta que a su vez hace las veces de inscripción al programa, a fin de determinar, no solo la magnitud del problema, sino las condiciones bajo las cuales se han construido las edificaciones, para identificar los estándares en cuanto a aspectos urbanísticos y constructivos. Con la información recolectada y definidas las condiciones técnicas y legales del Programa, se establecen entonces todos los instrumentos necesarios para ponerlo en marcha, los cuales comprenden: la normatividad especial a aplicarse para el reconocimiento, los requisitos y procedimientos, los mecanismos para facilitar y acercar a la comunidad al proceso, para culminar con la propuesta de un programa de capacitación y sensibilización, que conlleve a disminuir en el municipio la práctica de la construcción ilegal de vivienda.

Abstract: Starting from the will of La Estrellas Municipal Administration to respond to a felt necessity of their community which is the one of being able to legalize their built housings to the margin of the requirements and of the city-planning and constructive norms, a Program of Recognition of ¡llega¡ Constructions is formulated. The formutation of the Program is developed starting from the realization of a diagnosis that goes from the general information of the municipality, the evaluation of the records of its gliding process, its authorities in this matter and its constructive development, until the Plan of Territorial Classification and, in particular, the analysis of the residential use, its types and norms. Equally, for goods of the regulatory scheme of the program and consideration of the dispositions of superior hierarchy to those that should undergo the municipality, the norms, laws and ordinances of national order are analyzed, inherent to the construction licenses and the recognition of constructions. As complement to the diagnosis and according fo the results of the evaluation of the topics before rnentioned, he/she is carried out a survey that in turn the times of inscription ago to the program, in order to determine, not alone the magnitude of the problem, but the conditions under which the constructions have been built, to identify the standards as for city-planning and constructive aspects. With the gathered information and defined the technical and legal conditions of the Program, settle down aH the necessary instruments then to start it, which understand: the special norms to be applied for the recognition, the requirements and procedures, the mechanisms to facilitate and to bring near to the community to the process, to culminate with the proposal of a training program and sensitization that it bears to diminish in the municipality the practice of the illegal construction of housing.
