"Los estándares de convencionalidad aplicables al derecho disciplinario colombiano"

Abstract

Esta tesis tiene como objetivo corroborar si las leyes disciplinarias colombianas cumplen con los estándares internacionales de la Corte Interamericana de Derechos Humanos en el marco del Derecho Disciplinario colombiano. Así, a partir de una interpretación sistemática de la ley colombiana, la jurisprudencia nacional e internacional y la doctrina jurídica, el estudio determinará si el Estado no sólo se adhiere a la Convención Americana sobre Derechos Humanos sino que también respeta sus límites en cuanto a las Garantías Judiciales (artículo 8.2. ); el Principio de Legalidad y de Retroactividad (artículo 9) y la restricción de los Derechos Políticos (artículo 23.2), de los trabajadores del Estado sujetos a la ley disciplinaria.

This thesis aims to corroborate if Colombian disciplinary laws comply with the international standards of the Inter-American Court of Human Rights within the framework of Colombian Disciplinary Law. Thus from a systematic interpretation of Colombian law, national and international jurisprudence and legal doctrine, the study will determine if the State not only adheres to the American Convention on Human Rights but also respects its boundaries regarding the Right to a Fair Trial (article 8.2.); the Principle of Legality also know as the Freedom from Ex Post Facto Laws (article 9) and the restriction of the Right to Participate in Government (article 23.2), of State workers subjected to disciplinary law.
