¿Para qué sirve una comunidad jurídica sin función social? : análisis realista de la reparación del daño inmaterial de las víctimas de ejecuciones extrajudiciales - falsos positivos

Abstract

El presente trabajo tiene por objeto identificar y analizar las razones que subyacen a la práctica, actividad y razonamiento judicial en la jurisdicción de lo contencioso administrativo a la luz del realismo jurídico norteamericano. Con base en esto, se pretenden estudiar algunas de las razones que explican cómo las dinámicas implícitas en la actividad judicial impiden que se materialice verdaderamente el derecho a la reparación integral de las víctimas de ejecuciones extrajudiciales – falsos positivos debido a que, en muchos casos, los jueces parecen dirigirse más a la comunidad jurídica que a las propias víctimas y sus intereses, desdibujando así la esencia de la función judicial de impartir justicia consagrada en el artículo 229 de la Constitución Política.

The purpose of this work is to identify and analyze the reasons underlying the judicial practice, activity, and reasoning in the contentious-administrative jurisdiction in the light of North American legal realism. Based on this, we will study some of the reasons that explain how the dynamics implicit in judicial activity prevent the right to full reparation of the victims of extrajudicial executions (false positives) from being truly materialized. In many of these cases, judges seem to address the legal community more than the victims themselves and their interests, thus blurring the essence of the judicial function of imparting justice enshrined in article 229 of the Political Constitution.
