El juez natural y el principio de igualdad penal en la constitución colombiana

En este ensayo se cuestiona si es necesario reformar el estatuto militar, con el objetivo de reducir la impunidad para la que se presta estas normas, avanzar en el respeto de los derechos es una tarea que le corresponde al estado, los funcionarios públicos que en si representan el estado real con rostros, deben trabajar para contar con personal calificado que mas que acatar las ordenes, tenga otros valores como pensamiento original, sentido común, normas morales y éticas. Lo que en Colombia se conoce como la justicia penal militar, no es otra cosa que la organización judicial, consagrada en el articulo 116 de la constitución nacional, encargada de investigar y juzgar los delitos cometidos por los militares en servicio activo. La justicia penal militar es una justica administrativa ya que depende del ministerio de defensa, a este respeto la corte constitucional con ponencia del magistrado Vladimiro naranjo conceptuó: que la justicia penal militar no forma parte de la rama judicial. El presente trabajo indaga por las garantías procesales que tuvieron los militares involucrados y si se les violo el derecho al juez natural, por ser competencia la justicia penal militar. La judicialización a los militares implicados, conto con una serie de circunstancias coyunturales como los medios de comunicación, las criticas de las ONG contra el sistema colombiano, el gobierno militarista del presidente de la época, la necesidad de las fuerzas militares por limpiar su nombre y transmitir un parte positivo a la opinión publica de que las cosas estaban haciendo bien y castigando a los responsables de los supuestos falsos positivos
