Este trabajo de grado profundiza en un aspecto trascendente para la calidad de vida de los ciudadanos del mundo y por supuesto, de Colombia porque está en la raíz misma de la naturaleza existencial como lo es el agua, que se asume dentro del ordenamiento jurídico. En consecuencia, se ha analizado desde la óptica de los derechos humanos universales consagrados, a su vez, en los cimientos constitucionales del país, consolidados con el bloque de constitucionalidad y reglamentados en las leyes y decretos respectivos. En vigilancia académica de las dificultades que afronta el medio ambiente y a la escasez hídrica que vive la tierra con secuelas negativas en la calidad de vida de amplias regiones de la humanidad, entre ellas varias de Colombia, se ahonda en los argumentos doctrinales y jurisprudenciales del acceso al agua potable con base en las normas del Derecho Internacional Público y en la normatividad constitucional y legal colombiana, con el propósito de establecer los asientos jurídicos que hacen del acceso al agua potable un derecho fundamental. En específico, se examinan los acuerdos internacionales más relevantes concernientes a derechos humanos y recursos hídricos, así como los documentos relativos al agua potable en la jurisprudencia internacional, en especial, los expedidos por organismos internacionales como la Organización de las Naciones Unidas, la Corte Interamericana de Derechos Humanos y el Tribunal Europeo de Derechos Humanos, entre otros. Por medio de este trabajo de posgrado se ha pretendido clarificar la situación del derecho al agua en el marco del Derecho internacional y de la legislación nacional, pues ya se ha promulgado amplia reglamentación que, por una parte, resguarda la demanda básica de agua potable y, por otra, reconoce el acceso al preciado líquido como un derecho humano de carácter fundamental. This work of degree deepens in a transcendent aspect for the quality of life of the citizens of the world and of course, of Colombia because it is at the very root of the existential nature such as water, which is assumed within the legal system. Consequently, it has been analyzed from the standpoint of universal human rights consecrated, in turn, in the constitutional foundations of the country, consolidated with the block of constitutionality and regulated in the respective laws and decrees. In academic monitoring of the difficulties faced by the environment and the scarcity of water that lives the earth with negative consequences on the quality of life of large regions of humanity, including several in Colombia, it delves into the doctrinal and jurisprudential arguments of access to drinking water based on the rules of Public International Law and Colombian constitutional and legal regulations, with the purpose of establishing the legal seats that make access to drinking water a fundamental right. Specifically, it examines the most relevant international agreements concerning human rights and water resources, as well as documents related to drinking water in international jurisprudence, especially those issued by international organizations such as the United Nations Organization, the Inter-American Court of Human Rights and the European Court of Human Rights, among others. Through this postgraduate work, it has been tried to clarify the situation of the right to water within the framework of international law and national legislation, since ample regulation has already been promulgated that, on the one hand, protects the basic demand for drinking water and , on the other hand, it recognizes the access to the precious liquid as a fundamental human right.
