Indulto en el marco del postconflicto; una vulneración a la condición de víctimas de los menores de edad entre los catorce (14) y dieciocho (18) años desvinculados de las FARC

Se entiende que, es el Estado el garante de los derechos de la niñez al interior de un país y por ende es él, quien debe velar por que sus niños y niñas no sufran de manera directa las consecuencias de la guerra. Cuando un menor de edad ingresa a las filas de un grupo armado al margen de ley, ya sea de manera voluntaria u obligada, ante la mirada indiferente de las instituciones que conforman el Estado, se manifiesta en todo su esplendor la omisión y negligencia de este, que a su vez pierde legitimidad frente al poder sancionatorio en lo que a esta población respecta. De manera que, siendo el estado el responsable de que los menores de edad resulten vinculados de una u otra forma en el conflicto armado, como actores beligerantes, no puede ese mismo estado que no brindó garantías de protección a los menores ante la guerra y que fue permisivo con las actuaciones realizadas por los grupos armados que perjudicaron el bienestar de esta población, pretender ahora investigarlos, juzgarlos e imponerles cualquier tipo de sanción. De esta forma, el indulto carece de idoneidad cuando se trata de menores de edad desvinculados de las FARC, que ostentan la calidad de víctimas. Lo anterior encuentra su sustento en que el indulto, es una institución jurídica que extingue la pena que haya sido previamente impuesta, es decir, solo es aplicable una vez se haya determinado la responsabilidad por parte de la justicia, respecto a la comisión de un delito determinado; por lo tanto, estas menores víctimas terminarían recibiendo un tratamiento penal similar al de cualquier otro actor beligerante. El proceso de desvinculación de los menores de edad en el conflicto armado colombiano, debe alejarse de situaciones adversas tales como ocurrieron en Ruanda, donde miles de niños inmersos en la guerra fueron finalmente juzgados a pesar de que, en la mayoría de los casos, no decidieron por voluntad propia hacer parte de los grupos beligerantes. Muchos niños entonces huyeron de Ruanda, muchos otros fueron juzgados y pagaron con su libertad y hasta con su vida el precio de una paz que no les garantizó sus derechos como víctimas. Es por eso que los procesos de paz en general, no deben señalar a los menores de edad, sino más bien refugiarlos, brindarles medidas no solo de restitución y reparación, también de rehabilitación y garantías de no repetición, pues serán estos niños parte del futuro de la sociedad colombiana. Es por ello que la aplicación del indulto, en virtud de los acuerdos de la habana, entre el gobierno de Colombia y la Guerrilla de las FARC, que se plantea en el comunicado conjunto Nº 070, y que se aplicaría a los menores de edad entre 14 y 18 años que formen parte de las filas de esta guerrilla, por delitos de rebelión y conexos, efectivamente vulneraria la condición de víctimas del conflicto armado que ostentan estos menores. The foregoing is based on the fact that the pardon is a legal institution that extinguishes the penalty that has been previously imposed, that is, it is only applicable once the responsibility has been determined by the justice, regarding the commission of a crime determined; therefore, these minor victims would end up receiving a criminal treatment similar to that of any other belligerent actor. The process of disengagement of minors in the Colombian armed conflict should move away from adverse situations such as occurred in Rwanda, where thousands of children immersed in the war were finally tried despite the fact that, in most cases, they did not they decided of their own volition to be part of the belligerent groups. Many children then fled Rwanda, many others were tried and paid with their freedom and even with their lives the price of a peace that did not guarantee their rights as victims. That is why peace processes in general, should not point to minors, but rather to shelter them, provide them with measures not only of restitution and reparation, but also of rehabilitation and guarantees of non-repetition, as these children will be part of the future of Colombian society.
