Análisis de los desafíos de la adopción homoparental en Colombia

Abstract

En el mundo suscita una controversia que se ha mantenido en el tiempo y permea diversos Estados indistintamente de su tipo de gobierno, de la religión preponderante o del continente al que pertenezcan; tal debate se da alrededor de la adopción de menores de edad, no por su naturaleza misma sino en razón a la posibilidad de facultar a las parejas homosexuales para ostentar la calidad de adoptantes. Con esta investigación se pretende analizar la situación actual de la adopción homoparental a nivel internacional, guiada por el contexto socio-jurídico de los países que más cambios relevantes han presentado en el tema y conducida por la jurisprudencia de la Corte Interamericana de Derechos Humanos a partir de la cual se han originado vinculantes preceptos jurídicos aplicables en los países firmantes; sin perjuicio de una intelección histórica de la metamorfosis socio-jurídica del sistema de adopción en aras de obtener una perspectiva holista al respecto. La investigación ha logrado tener un enfoque principalmente jurídico sin apartarse del aspecto sociológico, psicológico y antropológico, previendo una interdisciplinariedad a partir de la cual se desarrolla el análisis de los estudios que distinguen resultados contrastables.

This research aims to analyze the current situation of homoparental adoption at the international level, guided by the socio-legal context of the countries that have made the most significant changes in the subject and conducted by the jurisprudence of the Inter-American Court of Human Rights From which binding legal precepts have originated applicable in the signatory countries; Without prejudice to a historical understanding of the socio-legal metamorphosis of the adoption system in order to obtain a holistic perspective on the subject. The research has managed to have a mainly legal approach without departing from the sociological, psychological and anthropological aspects, foreseeing an interdisciplinarity from which the analysis of studies that distinguish testable results is developed.
