Análisis, barreras y posibles soluciones sobre la protección de los derechos fundamentales de los niños, niñas y adolescentes venezolanos refugiados en Tunja

Abstract

The economic and social crisis in Venezuela led to many citizens having to leave theircountry due to political persecution and ignorance of the state regarding the protection of their rights such as life and security. In the present work, a documentary analysis of laws and judgments will be carried out in which it will be sought to determine are the main fundamental rights of Venezuelan refugee children and adolescents in Colombia, then results will be determined are the mechanisms and procedures to follow to make effective the fundamental rights of nationality, regularization, education and health rights of the study population in the city of Tunja, identifying the barriers presented in the implementation of the aforementioned rights. As a third part of the development of the monograph, surveys were conducted with Usta Tunja students belonging to the Legal Assistance Program for Population in Need of International Protection, who carry out processes with the Venezuelan refugee population, including girls and adolescents in order to verify the incidence of barriers in the fulfillment of the rights of nationality, regularization, education and health of the Venezuelan children and adolescents who are refugees in Tunja, according to the development of their legal practice within the program. Finally, the barriers that arise in the protection of the main fundamental rights studied (nationality / regularization, health and education) will be analyzed and some basic strategies will be proposed to solve them.
