Resumen
Maritime piracy is a problem that is currently positioned as one of the main threats to international security, in view of the fact that it causes serious human and economic losses to the Member States because it affects the free and smooth navigation of different geographical areas of the world, in addition, bearing in mind that this has been a means of global interconnection used since antiquity that enhances relations between different regions of the world and has allowed the exchange of countless benefits, the existence of a threat disrupting the normal development of navigation is a challenge that States and the international community in general must address in order to combat it by using different alternative mechanisms to which a State would employ individually, as in the case of cooperation on surveillance, control and information between authorities in different countries to ensure the effective capture of pirates.
In addition to the challenges that this phenomenon represents for the international arena, in the legal sphere, it is also problematic since the criminalization of the conduct and determination of the competent judge to sanction pirates is often an arduous task, since international law may sometimes conflict with the criminal law systems of States, which makes it difficult to impose short-term penalties on pirates
