This research work is motivated by the massive nature of the phenomenon of violence against women by their partners or ex-partners, so that, based on the verification that there is proportionality between victimization and impunity, take advantage of the elements of the main theories of gender justice to propose, based on their postulates, reflections and recommendations that can improve the guarantee of access and the materialization of justice.
The development of the document required the application of three methodological axes that guide legal research, whose typologies have been defined as: 'applied', 'socio-legal' and 'descriptive', which is reflected in the three chapters, through which the It mainly established that: a) There are no important contributions to the legal framework or public policies by gender justice theories and feminist movements in the comprehensive approach to the phenomenon. Intersectionality is fundamental to advance in its eradication since it is evident that it is legislated for a specific type of woman, urban and heterosexual; b) Restorative justice models, due to their pedagogical and restorative emphasis, broaden the perspective to understand the determinants of the phenomenon without neglecting punitive responsibility; c) The problem demands a broad and comprehensive intervention. The solutions do not arise only from justice (the State) but from recognizing the need to provoke, essentially through education, a transformation on the individual in the political, social, cultural and religious scene.
