Interpretación de garantías en derechos sexuales y reproductivos: Una mirada desde la violencia sexual y el conflicto armado en Colombia.

Abstract

International Humanitarian Law has recognized human rights as the basis of jurisdictional guarantees for the population, who through international treaties of which each State has committed to compliance, managed with the purpose of respect for human rights. In this way, regulations are the common idea in which all peoples and nations ensure measures that support identifying the person as a subject of rights in an equal and equitable manner. Likewise, the Organization of American States (OAS, 1969) in the American Convention on Human Rights through Chapter I List of duties: Article 1, exhorts States to respect rights and independence in the full exercise of full guarantees right with the motivation to avoid some type of discrimination, in this case the one that summons us sexuality, since it is constituted as the foundation of human relations and is related to rights: to intimacy, family formation, personality autonomy , and comprehensive training. In addition, these evidence the contribution of constitutional benefits through the provision of comprehensive services for the fulfillment of Human Rights, contained today in the aforementioned Constitutional Block Art 93 of the legal system, prevailing this to the internal order. This research is oriented towards the search for information in which the legal protection of sexual and reproductive rights is related under the principles of human dignity and solidarity through a qualitative approach, with the intention of exposing events identified in the context of the armed conflict in our country, delimiting the violation of sexual and reproductive rights using the legal method of analysis - synthesis. By means of the Documentary Investigation technique through the search for conceptual information and cases with in the armed conflict with content sheets about women who were mostly victims of the armed conflict aimed at answering the problematic question: Has the scope of the guarantees of sexual and reproductive rights for women who were victims of the armed conflict in Colombia?
