Resolución 9.70: lejos de garantizar seguridad alimentaria para los consumidores eco

Abstract

In Colombia the agricultural sector is characterized by the variety of the subsectors that comprise it, however the rice sector is one of the most important since it is one of the largest generators of employment in the rural sector, in addition to being one of the sectors with greater occupation of land and being an indispensable economic activity for more than 200 municipalities of the national geography. In recent years, resolution 9.70 of 2010 has been one of the most controversial due to its execution, which was marred by the destruction of more than seventy tons of rice seeds by the authorities, in addition to the opening of different judicial processes against peasants, merchants and seed producers for the violation of plant breeders' rights and resolution 9.70, which has generated in public opinion a discussion about the knowledge that the ICA has given to the rural population about the resolution . The analysis of the aforementioned resolution from an area as important as food security as a constitutional right, are current issues of great social, economic and legal impact, so it is necessary to analyze the effects that the resolution has caused, in order to to provide a critical and constructive analysis on issues such as this of current relevance. A constitutional right such as food security has been an emblematic issue in recent days, since it is essential to analyze the application of a rule outside of a specific community, which is the agricultural population, in order to determine the its efficiency, taking into account both the collective and general cost-benefit ratio. Therefore, it is indisputably essential to analyze these issues that will generate debates to analyze whether a regulation such as the aforementioned resolution is effective within all the areas that are being affected.
