dc.description.abstractThe ―Justicia y Paz‖ Tribunals in Colombia considered the sexual violence imputed to AUC‘s against civilian population in double way: like war crimes and crimes against humanity, what is was called: a double connotation. This investigation analyzed and undertood the phenomenon in the light of: i) the international criminal dogmatics and ii) the non bis in ídem principle. In transitional justice as was ―Justicia y Paz‖, despite the exceptions to ordinary criminal proceedings, the principles and guarantees of the penal system, the social and democratic State of law and international law must be respected. In the same way, when international crimes are imputed, the interpretation system should be that of the International Criminal Court. The foregoing, in order to provide judicial permanence and legal certainty and guarantee the rights of victims and defendants.
