        Resumen
        Reflection falls on the major issues that have generated dispute between the highest courts in Colombia and the effects generated in society. This confrontation known as journalistically train crash, it becomes, the benchmark for some of the relevant arguments nationwide, sometimes manage to last over time, thus the possible approaches that emerge in forms of theses by each corporation, they must be a prospect to guide the action and intervention not only of the public authorities, if they do not turn the society in general, thus allowing elucidate a solution or at least offer arguments for feed a rich social and legal debate on various issues of society and the system of social and democratic rule of law that sustains. This is why it is presented as the following research question: What have been the major decisions issued by the Constitutional Court and the State Council has shown inconsistency in the Colombian legal framework ? From the above, arise as objectives of this article, a general one which is to draw some basic concepts underlying the discussions between the High Courts and specific objectives are intended to illustrate through case specifically, some of the main issues that have presented the train crash and their impact on society. This article builds on a descriptive analytic methodology used texts and jurisprudence, around the relevant discussions of the High corporations , especially from the analyzes generated by the case law and various authors .
