Resumen
This article aims to analyze the socio-legal implications of the Temporary Statute of Protection for Venezuelan Migrants of the year 2021 that impact on migrants regarding health within the framework of the covid-19 pandemic. According to figures recorded by the Venezuelan Migration Observatory (OVM), more than four million Venezuelans have left their country due to the social, economic and political crisis that the country is going through. It is estimated that of these more than four million migrants according to IOM figures (2021), about 40% are in Colombia (or transit through it), as the main receiving country for Venezuelan migrants, not only because of its geographical proximity, but also because of the close relationship and cultural convergence that has historically existed between both nations. In the midst of the abundant migratory flow to Colombia and under the conditions imposed by the pandemic, the government of President Iván Duque launched an ambitious measure due to its significant number of target population, this is the Temporary Statute for the Protection of Venezuelan Migrants (ETPV) , a measure that, under the temporary protection regime, seeks to regularize more than a million Venezuelans who are undocumented or in irregular conditions throughout the entire national territory. Through qualitative tools such as documentary and press analysis, this reflection article aims to analyze the socio-legal implications established by Decree 216 of 2021 in matters of health / public health, understanding its special role and importance in the framework of the pandemic by coronavirus worldwide and its impact on the migrant population and the constitutional right to health.
