El ciber control parental: un mecanismo idóneo para salvaguardar el interés superior del menor, frente a los riesgos online

Abstract

The rise of information technology and communications has expanded the communication barriers we have. This communicative opening has made an impact at all levels of our society, however, in spite of affect positively in our communicative relationships it has also led to an excessive use of them; reflected in phenomena such as ciberbullying and revealing surprising statistics of inappropriate use that minors may make of them. In Colombia until 2013 our children shown vulnerable in the absence of proper regulation for the phenomenon of ciberbullying. With the promulgation of Law 1620 of 2013, protecting both minors and adults is guaranteed. Additionally, in order to achieve better protection and surveillance system against the possible risks to which our children are exposed, the Supreme Court by court order CSJ- SP-9792 of July 29, 2015, ordered the legitimate right parents to access information from their children, in full exercise of parental authority, in order to assist, guiding and controlling the communications of their minor children. The present article will address the problems of the main risks present in the web, and it will also analyze the figures of cybercontrol and parental control as suitable mechanisms in the safeguard of the best interests of the child.
