Abstract

In the processes in which the commission of sexual crimes against minors is investigated, in addition to complying with its legal and constitutional obligations, the Prosecutor's Office must execute the due diligence requirements imposed by the pro infans principle, according to which it must combine all its investigative efforts to materialize the fundamental rights of minor victims and to guarantee the search for truth, justice, reparation and non-repetition; In this regard, with the issuance of Law 1653 of 2013, the criminal proceedings brought against said crimes must comply with the measures to avoid revictimization, especially when the minor victims participate as witnesses in the oral trial, a trend that was even applied before the issuance of this law.
