Abstract
Through heuristic and hermeneutical analysis, criminal law and forensic psychiatry are supplied with elements from the multidimensional dynamics of context and individuality of being; there converges the dialectical expression of the social functioning of the individual represented in the clinical prognosis for the psychiatrist expert and the predictive and posdictive character for the criminal judicial operator. It is our claim that such convergence provides legal decisions in justice and equity, safeguarding the fundamental rights, criminal and local and international procedural criminal principles of those who apply under the autonomous institute of diminished imputability; whose approach and differential therapeutic-legal management, should be directed to the intervention of the factors that affect it from social prophylaxis, in charge of inter and multidisciplinary teams with intersectoral participation and of the academy that effectively and efficiently execute public policies issued of the government: sanitary, criminological, legislative and pedagogical, leaving aside the generic palliative scheme operating.
