El acusador privado en Colombia : breve comparación con Perú y Guatemala

Abstract

The creation of a special abbreviated penal process in Colombia, by means of the law 1826 of 2017, represents a necessary initiative in national legislature, because high congestion levels of the judicial system. In this abbreviated penal process act the private accuser corresponding to other international law figures, who can help to Public Ministry to investigate and accuse the punishable act. Implementing a qualitative comparative methodology, present report exposes the particularities of private accuser, in order to compare this whit particular and adhesive complainants, of Peru and Guatemala, respectively. For the purpose of explore their faculties, applicability, procedures and effectiveness within each legislation. With the aim of examine if really their application allows a better judicial procedure in each country.
