La autonomía de la universidad pública de orden departamental y municipal en Colombia desde la teoría institucional del derecho.

Abstract

In Colombia, the departamental and municipal public universities by virtue of their university autonomy, are empowered by the state to dictate norms and statutes to carry out their educational labor.

The university autonomy is reconfigured from the institutional theory of law defended by MACCORMICK, to name it legislative autonomy.

It was demonstrated through the content analysis methodology advocated by KRIPPENDORFF through evaluating the relationship of the parameter with the academic mission, magnitudes and scales, and the simulation of a hypothesis consisting on the reproduction of contractual and budgetary norms. Like the perception survey, it is argued that the departamental and municipal public universities give little or minimal importance to legislative autonomy, and therefore, not generating a university regulatory order.
