Abstract

El texto analiza la imputación jurídica elaborada por la Corte Suprema de Justicia en la sentencia SP 2339-2020 en aras de hacer un análisis de los límites y fundamentos de las categorías de autoría y participación criminal expuesta en la decisión. Específicamente, se examina la compatibilidad jurídico-dogmática entre la figura de la intervención y la coautoría mediata en delitos especiales. Lo anterior, para efectuar luego el análisis del caso concreto con especial énfasis sobre el concepto de dominio del hecho. Sobre ello, por delitos especiales se entienden aquellos delitos que exigen una calidad específica o cualificación objetiva al autor durante la ejecución de la conducta punible. Más concretamente se pretende dar respuesta a la pregunta: ¿aplica erróneamente la C. S. J. la intervención en el caso en concreto?

The text analyzes the legal imputation prepared by the Supreme Court of Justice in sentence SP 2339-2020 in order to make different observations on the limits and foundations of the categories of authorship and criminal participation exposed in the decision. Specifically, inquiries about the legal-dogmatic compatibility between the figure of intervention and mediate co-authorship in special crimes. The above, to then carry out the analysis of the specific case with special emphasis on the concept of domain of the fact. By special crimes we understand those crimes that require a specific quality or objective qualification to the perpetrator during the execution of the punishable conduct. More specifically, the text is intended to answer the question: does the Supreme Court of Justice wrongly apply the intervention in the specific case?
