Trata-se de um estudo teórico que toma como base as elaborações de Freud e Lacan, alguns comentadores de suas obras e a doutrina do Direito de Família. O que leva um sujeito a demandar o reconhecimento judicial de sua paternidade? Esta pergunta é o eixo de nosso trabalho. Os dois primeiros capítulos foram dedicados ao campo jurídico. Neles, trabalha-se a questão da filiação na legislação brasileira, da ação de investigação de paternidade e da sua prova mestra – o exame de DNA (Deoxyribonucleic acid). Nos capítulos subsequentes, será abordada a relação entre a Psicanálise e a ciência por meio da noção de um termo comum: o sujeito; os conceitos psicanalíticos de necessidade, demanda e desejo; a origem mítica da Lei Simbólica – o Édipo em Freud, o Nome-do-Pai e metáfora paterna em Lacan. Revisar-se-á a tão antiga e tão atual questão sobre o pai, relacionado-a com os três registros – real, simbólico e imaginário –, culminando com o conceito de Nomes-do-Pai. Em sequência, um capítulo foi dedicado ao nome próprio, destacando sua relação com três formas de identificação na teoria freudiana e com conceito de traço unário. Para finalizar a pesquisa, trabalham-se os conceitos de genealogia, incesto e filiação em Pierre Legrende. ______________________________________________________________________________ ABSTRACTThis paper is dedicated to research the demand for judicial recognition of fatherhood whose applicants are of legal age, holding a dialogue between Law and Psychoanalysis. This is a theoretical based on Freud's and Lacan's elaborations, and some reviewers of their works and teaching on Family Law. What leads an individual to sue for legal recognition of his fatherhood? This question is this work's center line. The first two chapters were dedicated to the legal field, in which the issue of filiation in Brazilian legislation was debated, the action of paternity and his master proof, the DNA test. The subsequent chapters deals with the relationship between psychoanalysis and science through the notion of a common term: the subject. Psychoanalytic concepts of need, demand and desire, the mythical origin of the symbolic Law – Oedipus in Freud and the Name-of-father and paternal metaphor in Lacan. We reviewed the current so old and so up to date issue about the Father in relationship with three levels of record, real, symbolic and imaginary, culminating with the concept Name of the Father. Following this, a chapter was devoted to the name of the subject, focusing on its relationship with three forms of identification in Freudian theory and concept of the unary trait. To finish the research, the concepts of genealogy, incest and filiation in Pierre Legrende's work have been considered.
