Abstract

The affiliation and transfer of regime by the affiliate must be free and spontaneous, which implies a duty of information by the Pension Funds since it is necessary that the person knows thoroughly the consequences of said decision could bring. The foul of this duty entails the void of the transfer made under such transgression, for the purpose of this one can be done again in due form. Thereby, it is necessary to determine which the legal liability of the different actors Pension System is, from the Pension Funds to the Superintendencia Financiera de Colombia, entity in charge of the supervision of the whole system. In the latter instance, it could be establish a State Liability in case there is an omission by said entity that might be sued for negligence.
