La crisis de la modernidad: una fractura del pensamiento político y jurídico

Abstract

This article is aimed to analyze what does the crisis in rationality mean from the legal and political elements that gave rise to the rupture in modern thinking and set up the foundations for postmodernity. There is evidence along this paper regarding how this event produces a paradigm change in legal thinking. The dogmatic methodology is used as the main one. The first part of the document presents how the crisis in modernity came about; the second one analyzes Carl Schmitt’s postulates; the third one shows the most important arguments in the legal and political fields of that time and, finally, the text offers some conclusions.

El presente artículo tiene como objetivo hacer un análisis del significado de la crisis de la racionalidad, desde los elementos legales y políticos que dieron origen a la ruptura del pensamiento moderno y plantó los fundamentos de la posmodernidad. A lo largo del texto se evidencia cómo este acontecimiento produce un cambio de paradigma en el pensamiento jurídico. La principal metodología utilizada es la dogmática. En la primera parte se expone la manera como se produjo la crisis de la modernidad; en la segunda se analizan los postulados de Carl Schmitt; en la tercera se muestran los principales argumentos en el campo jurídico y político de la época y, por último, se brindan algunas conclusiones.
