Desigualdad e inconsistencia de los patrimonios en la unión de hecho entre dos personas

Abstract

La Unión de Hecho se encuentra legalizada en el artículo 68 de nuestra Constitución, en el cual manifiesta que genera los mismos derechos y obligaciones que tienen las familias constituidas bajo matrimonio. El Artículo 222 del Código Civil Ecuatoriano dice que la unión de hecho estable y monogámica de más de dos años entre un hombre y una mujer libres de vínculo matrimonial, con el fin de vivir juntos, procrear y auxiliarse mutuamente, da origen a una sociedad de bienes. Las personas que se encuentran en unión de hecho podrán constituir patrimonio familiar, y la unión de hecho se terminará por los literales que se encuentran en el Art. 226 de nuestro Código Civil. Cabe manifestar que la Unión de hecho consta en nuestra legislación ecuatoriana, pero hay que realizar un estudio más profundo donde se encuentre especificadamente en un solo capítulo todo lo que exista en la unión de hecho.

The Fact Union is approved in Art 68 of our Constitution, stating that the same rights and obligations belong to it as families constituted under marriage. Art 222 of the Ecuadorian Civil Code provides that the stable and monogamy factual union of more than two years, between a woman and a man free from a marriage link, in order to live together, procreate and help each other, creates a real society. People living in a fact union can constitute family heritage, and the fact union and shall be as literals of Art. 226 of the Civil Code. It is worthy mentioning that the fact union is provided in the Ecuadorian legislation, but further studies are required, where all elements on the fact union are gathered in one single chapter.
