Os crimes passionais, as teses de defesa e as teses de acusação: (des) construindo discursos

Abstract

The presented dissertation entitled : The crimes of passion, the defense thesis and prosecution arguments : ( de) constructing discourses represents a study about the issue of passion crimes in today's society, from the survey conducted in five cases of felonies against life, occurred in Rio Grande city, which were a jury in the first years of the XXI century. There were three consummated homicides and two attempted murders of men against women, still bringing to society the question of gender violence and patriarchal setting of this society. We used as a research method the Qualitative Content Analysis in which are identified the categories and units of analysis present in the discourse of theses. Our central research problem is to understand why these crimes remain occurring and the ways in which discourses are constructed and legitimized. This way, the jealousy, the violent emotion, the defendant's past life and self-defense (of honor) are recurrent in the discourses we analyzed. These arguments are grounded on the part of the thesis defense of defendants who appropriate it to strengthen the arguments of the defense and, by the arguments of prosecution to disqualify them within the processes. The exercise of discursive construction and deconstruction by selecting the categories and units of analysis enables also building a speech that ends up questioning the society itself.

A dissertação que se apresenta intitulada: Os crimes passionais, as teses de defesa e as teses de acusação: (des) construindo discursos representa um estudo sobre a temática dos crimes passionais na sociedade hodierna, a partir da pesquisa realizada em cinco processos de crimes dolosos contra a vida, ocorridos na cidade do Rio Grande, que foram a júri popular nos primeiros anos do século XXI. Foram três homicídios consumados e duas tentativas de homicídios de homens contra mulheres, colocando ainda em pauta na sociedade a questão da violência de gênero e da configuração patriarcal dessa mesma sociedade. Utilizamos como método de investigação a Análise de Conteúdo Qualitativa em que são identificadas as categorias e as unidades de análise presentes nos discursos das teses. Nosso problema central de pesquisa consiste em compreender porque permanecem ocorrendo esses crimes e as formas como os discursos são construídos e legitimados. Assim o ciúme, a violenta emoção, a vida pregressa do réu e a legítima defesa (da honra) são recorrentes nos discursos que analisamos. Essas argumentações estão alicerçadas, por parte das teses de defesa dos réus que se apropriam delas para fortalecer as argumentações da defesa e, por parte das teses de acusação em desqualificá-las dentro dos processos. O exercício da construção e desconstrução discursiva através da seleção das categorias e das unidades de análise possibilita que se construa também um discurso que acaba por problematizar a própria sociedade.
