| dc.description | En este estudio se analiza comparativamente la concepción del Derecho inglés o anglosajón (common law) y del Derecho romano clásico (ius), con el fin de comprender la esencia, el espíritu jurídico, el método utilizado tanto para la elaboración, e interpretación, como para la aplicación o realización del Derecho, así como también el genio jurídico de sus juristas, partiendo de aquellos principios en los que coinciden, o por el contrario divergen, procurando siempre ver, no sólo el genio jurídico a ellos comunes, sino la diversidad histórica en la que estuvieron inmersos. El objetivo, lejos de demostrar influencias recíprocas, o pretender agotar los puntos de encuentro entre estos ordenamientos jurídicos, estará circunscrito a exponer brevemente un elemento a ellos intrínseco y común: el arte jurídico, que los romanos llamaron ius y los ingleses, razón artificial. | |

| dc.description | This study comparatively analyzes the conception of the English or common law and classical Roman law (ius) in order to understand the essence the legal spirit the method used both for processing, and interpretation, as for the implementation or execution of the law , as well as the legal genius of its jurists, based on those principles which coincide, or otherwise diverge, always trying to see, not only the common legal genius to them , but the historical diversity in which they were immersed. The goal, far from demonstrating reciprocal influences or pretending to exhaust the points of contact between these legal systems, shall be limited to them briefly expose an intrinsic and common element: the legal art, which the Romans called ius and Englishmen artificial reason. | |
