La institución de la quiebra en el Sistema venezolano se aplica únicamente a los sujetos calificados como comerciantes. Las sociedades agrarias, si bien utilizan figuras jurídicas societarias para organizarse y desarrollarse, o bien, constituyen sociedades civiles o sociedades mercantiles. Ahora bien, considerando que la utilización de la forma mercantil no conlleva la tipificación mercantil, dicha sociedad no puede ser calificada como comerciante, y en consecuencia no le es aplicable el procedimiento de quiebra. Agrarian societies, while using the figure of legal societies to organize and develop, they are either civil or mercantile societies. However, considering that the use of the trade figure does not involve the commercial classification, these societies cannot be described as commercial, and therefore, bankruptcy proceedings cannot be applied. Nevertheless, the modern trend leads to the non-differentiation of the taxpayer, submitting both commercial and non commercial to the procedure and therefore the approach to this research.
