The protection of human rights in Mexico has, de jure, suffered an important change in the last years, given a new judicial interpretation delivered by the National Supreme Court of Justice that allows the use of conventionality control, which means, that it allows federal and state judges to verify the conformity of domestic laws with those established in the Inter-American Convention of Human Rights. To what extent domestic actors are protecting human rights using this new legal tool called conventionality control? In this article I explore whom and how is conventionality control being used in Mexico. Using N-Vivo Software I reviewed concluded decisions delivered by intermediate level courts (Collegiate Circuit Courts) in three Mexican states. The evidence points that conventionality control is a very useful tool especially to defenders, who appear in sentences claiming compliance with the commitments Mexico has acquired when this country ratified the Convention. A proteção dos direitos humanos no México sofreu, de jure, uma evolução importante nos últimos anos, dada uma nova interpretação judicial da Suprema Corte de Justiça que permitiu o uso do controle de convencionalidade, isto é, permitiu que juízes federais e estaduais verifiquem a conformidade das leis nacionais com o que estabelece a Convenção Interamericana de Direitos Humanos. Até que ponto os atores nacionais estão protegendo os direitos humanos utilizando este novo instrumento legal? Neste artigo exploro quem e como se está usando o controle de convencionalidade no México. Usando o software N-VIVO revisei as sentenças conclusas proferidas pelos tribunais de nível intermediários em três estados mexicanos. Os resultados permitiram observar que o controle de convencionalidade é uma ferramenta muito útil, especialmente, para os defensores que aparecem nas sentenças reivindicando o cumprimento dos compromissos que o México adquiriu ao ratificar a Convenção.
