dc.description.abstractEl presente artículo analiza la privación de libertad de niños, niñas y adolescentes como mecanismo de control de la niñez empobrecida; dispositivo inherente al perimido paradigma de la situación irregular. Se considera la institucionalización a la luz de la Ley 26061 de Protección Integral de Derechos y los artículos 37 y 40 de la Convención Internacional de los Derechos del Niño, piedras angulares en la creación de una nueva institucionalidad respetuosa de los derechos de los niños, niñas y adolescentes.
dc.description.abstractThe present article analyzes the deprivation of liberty of children and adolescents as a control and disciplinary mechanism on the impoverished childhood; device inherent in the expired paradigm of the irregular situation. Institutionalization is considered in the light of comprehensive rights protection law 26061 and articles 37 and 40 of the International Convention on the Rights of the Child, key aspects in the creation of a new institutionalism, respectful of rights of children and adolescents.
