In recent decades, international human rights law has had a growing impact on domestic legal systems throughout the world and has therefore also influenced the daily work of judges, prosecutors and lawyers. The consecration of these rights that were reflected in declarations, international treaties and constitutional texts, which means the most important achievement for all humanity and especially for the law itself. But for the effectiveness of these rights to be effectively ensured in practice, it is necessary to create new procedural instruments to prevent or remedy the violation of human rights. In that sense, the Judiciary to violate the Judicial Guarantees established in international treaties such as the American Convention on Human Rights is seriously violating the fundamental rights of individuals who seek access to the Justice System by not respecting the Due Process of Law by The Judicial Bodies. One serious concern rests with the data and statistics obtained from the Inter-American Court of Human Rights, as it can be seen that Peru is one of the countries that has the most complaints against it for violation of Human Rights, thus concluding that Power Judicial Peruvian is not performing its functions properly, which constitutes a serious threat against the protection of human rightsEn décadas recientes, el Derecho Internacional de los Derechos Humanos ha tenido un creciente impacto en los sistemas legales internos en todo el mundo y en consecuencia ha influido igualmente en el trabajo diario de Jueces, Fiscales y abogados. La consagración de estos derechos que se plasmaron en declaraciones, tratados internacionales y textos constitucionales, lo cual significo el logro más importante para toda la humanidad y en especial para el derecho mismo. Pero para que la eficacia de estos derechos quede asegurada en la práctica logrando así su efectiva protección es necesario crear nuevos instrumentos procesales para prevenir o reparar la violación de los derechos humanos. En ese sentido, el Poder Judicial al vulnerar las Garantías Judiciales establecidas en tratados internacionales como son La Convención Americana sobre Derechos Humanos está vulnerando gravemente los derechos fundamentales de los justiciables que pretenden acceder al Sistema de Justicia al no respetarse el Debido Proceso legal por parte de los Órganos Judiciales. Una honda preocupación recae en los datos y estadísticas que se obtienen de la Corte Interamericana de Derechos Humanos, pues se puede apreciar que Perú es uno de los países que más denuncias presenta en su contra por vulneración de los Derechos humanos, concluyendo así que el Poder Judicial Peruano no está cumpliendo con sus funciones adecuadamente, lo cual constituye una grave amenaza en contra de la protección de los Derechos humanosTesis
