| dc.description | Quando os pais são incapazes de distinguir as relações de conjugalidade e parentalidade, os filhos podem se tornar importantes instrumentos de retaliação contra o parceiro. Valendo-se de falsas acusações e manobras para dificultar o convívio dos filhos com um dos pais, o alienador ignora os deveres inerentes ao exercício da autoridade parental, em um verdadeiro “abuso moral” contra os direitos fundamentais da criança e do adolescente. Neste ponto, desponta de grande relevância analisar a efetividade das medidas judiciais frente a essa situação, já que o legislador brasileiro atribuiu ao magistrado a função de adotar todas as medidas necessárias para preservação da integridade psicológica do filho e assegurar sua convivência com seu genitor diante de indícios de condutas alienantes. Por outro lado, não basta impor o direito de visita ou de guarda, é necessário cuidar daquela família para que ela desenvolva-se em um lugar seguro, onde o filho seja protegido, resguardado e incentivado a uma convivência familiar efetivamente ampla, tornando-se imperiosa a análise da aplicação das medidas extrajudiciais da mediação familiar e do tratamento terapêutico compulsório nos litígios em que sejam detectados atos de alienação parental. Para tanto, foi realizada uma análise da bibliográfica nacional, de pesquisas realizadas nas varas de família do Poder Judiciário brasileiro e de julgados sobre o assunto. Após a coleta dos dados, constataram-se graves dificuldades na imposição isolada das medidas judiciais, sendo, então, proposta a intervenção conjunta com os meios extrajudiciais, como uma via mais efetiva para garantia da convivência familiar e do melhor interesse dos filhos diante das condutas alienantes. | |

| dc.description | When parents are unable to distinguish the conjugal relations and relations of parenting, children can become important instruments of retaliation against the partner. Making use of false accusations and maneuvers to hinder the interaction of children with a parent, alienating parent ignores the duties inherent in the exercise of parental authority, in a true "moral abuse" against the rights of children and adolescents. At this point, emerges the great importance of analyzing the effectiveness of judicial measures against this situation, because the Brazilian legislator has assigned to judge the function to take all necessary measures for maintenance of the psychological integrity of the child and to ensure their interaction with your parent in front of indications of alienating behaviors. On the other hand, it is not enough enforce the visiting or custody rights, but it is necessary care of that family so they can develop in a safe place where the child is protected, safeguarded and encouraged to a family life effectively wide, also becoming imperative to examine the application of extrajudicial measures of family mediation and compulsory therapeutic treatment in judicial disputes in which acts of parental alienation are detected. To this end, an analysis of national literature, a research in the family Brazilian courts and an analysis of judgments on the subject was carried out. After gathering the data, difficulties in using judicial measures it was found, and the joint intervention with extrajudicial measures, as a more effective way to ensure the family living and the best interest of the children in front of alienating behaviors being proposed. | |
