Dentro de la presente investigación se tratan temas relacionados con los diversos aspectos concernientes a la Partición Extrajudicial de los bienes hereditarios, haciendo un abordaje de manera particular a los problemas e inconvenientes a los que se enfrentan los ciudadanos cotidianamente. Al estar esta institución reconocida dentro del Ordenamiento Jurídico Ecuatoriano plantea dos opciones para su debida ejecución y aplicación, en un primer escenario tenemos la facultad que no implica mayor solemnidad como es acudir ante un Notario y elevar a Escritura Publica la Partición de los bienes. Quedando el tema Partición Judicial de manera general en cuanto a la validez y eficacia de la misma.The present research deals with topics that are related with various issues with the Extrajudicial Partition of heritage assets, making a particular approach to the problems and inconveniences that citizens face on a daily basis. Being this recognized institution within the Ecuadorian Legal System it presents two options for its due implementation and application, in a first scenario we have the faculty that does not imply greater solemnity as it is to go before a Notary and raise the Deed of assets to Public Deed.
