| dc.description | El desarrollo del presente tema referente a la Responsabilidad Penal del Médico por Mala Práctica Profesional nos muestra cuándo un profesional de la salud debe responder penalmente por el mal ejercicio de su profesión, considerando que la salud y la vida del ser humano es lo que se encuentra en riesgo al infringir el deber objetivo de cuidado al que se encuentran obligados.
Se buscó analizar el alcance del tipo penal referente al homicidio culposo por mala práctica profesional, estudiar los supuestos establecidos en el Art. 146 del Código Orgánico Integral Penal, con la finalidad de determinar si éste artículo está destinado a perjudicar o no a los galenos, o si podría ser considerado como un escudo protector tanto para los profesionales, como para los pacientes. La infracción del deber objetivo de cuidado por parte del facultativo no sólo puede ocasionar la muerte de su paciente, sino que también puede originar lesiones, por ello se trata de abordar las consecuencias penales que acarrean las mismas, según lo establecido en el Art. 152 del COIP.
Considerando que en la actualidad no es un solo médico el que se encarga del cuidado y atención del paciente, se realiza una investigación del equipo médico, la división del trabajo y la responsabilidad de ellos en las distintas actividades.
Finalmente, se realiza un estudio de la importancia de la prueba, entre ellas la correcta elaboración de la historia clínica, para determinar si el profesional de la medicina ha incurrido en responsabilidad penal. | |
| dc.description | The development of this topic concerning Criminal Responsibility for Medical malpractice shows when a health professional should be held criminally responsible for the bad practice of their profession, considering that the health and life of human beings is what lies at risk to violate the objective duty of care to which they are bound.
This study analyzed the scope of the offense relating to negligent by malpractice murder, study the circumstances set forth in Art. 146 of the Criminal Comprehensive Organic Code, in order to determine if this article is intended to harm or not the doctors, or whether it could be considered as a protective shield for both professionals and patients. Infringement of objective duty of care by the practitioner can not only cause the death of his patient, but can also cause damage, so it is addressing the criminal consequences resulting thereof, as provided in Art. 152 the COIP.
Whereas at present is not one doctor who is responsible for the care and attention of the patient, an investigation of the medical team, division of labor and responsibility for them in the various activities is performed.
Finally, a study of the importance of the test, including the proper development of the history, is performed to determine if the medical professional has incurred criminal responsibility. | |
