| dc.description | Over time, the way to understand and conceptualize the security has been changing, which has been influenced by the current events and the needs that should be answer in every age. Hence, we can speak of a paradigm shift in relation to security, where stops focusing on the State to switch to concern with the welfare of the people and giving them participation in this task. It is known as citizen security.
This new way of dealing with security, involves the respect and guarantee of human rights as a priority component, which entails to maintaining a proper alienation of the public policies relating to citizen security, respecting their human rights. This fact comes into question with the implementation of the “Libertador” project, which seeks to perform telephone interceptions in order to obtain information that serve as evidence in criminal proceedings, using technological tools.
Thus, there is a need to establish the relationship between public safety and human rights in the Ecuador, in order to determine any restrictions on freedoms or rights violations that are conducted to ensure the safety of persons.
So, it is necessary to know the structure, operation and scope of the “Libertador” project, and then, through a weighting of rights, establish the impact that this project can generate in the human rights, such as the privacy ant the inviolability of correspondence. | |
| dc.description | Con el paso del tiempo se ha ido modificando la manera de entender y de conceptualizar a la seguridad, la cual ha sido influenciada por los acontecimientos del momento y las necesidades a las que debía responder en cada época. Existiendo un cambio de paradigma en relación a la seguridad, dejando de centrarse en el Estado para pasar a preocuparse por el bienestar de las personas y además otorgándoles participación activa en la seguridad ciudadana.
Esta nueva forma de tratar a la seguridad, involucra al respeto y garantía de los Derechos Humanos como un componente prioritario, lo que conlleva mantener una adecuada alienación de las políticas públicas de seguridad ciudadana con el respeto de estos derechos. Este hecho entra en cuestionamiento con la implementación del Proyecto Libertador, que busca mediante el uso de herramientas tecnológicas realizar interceptaciones telefónicas con el fin de recabar información que sirva como prueba dentro de un proceso penal.
De tal manera, que se busca determinar las posibles restricciones de libertades o violaciones de derechos que se realizan con el fin de garantizar la seguridad de las personas, de donde surge la necesidad de establecer la relación existente en el Ecuador entre la seguridad ciudadana y los Derechos Humanos.
Por lo que se requiere conocer la estructura, funcionamiento y alcance que tiene el Proyecto Libertador, para luego de ello a través de una ponderación de derechos, establecer la incidencia que este proyecto puede generar a derechos como la privacidad, la intimidad, la inviolabilidad de correspondencia. | |
