El presente trabajo de investigación pretende demostrar la vulneración del derecho constitucional al trabajo por la coexistencia de la precarización laboral desde el aparecimiento de los servicios técnicos especializados autorizados por el Mandato Constituyente N° 8 y su Reglamento, norma que no ha eliminado la precarización laboral, circunstancia que desvirtúa el espíritu de protección de la relación laboral al permitir la contratación civil de servicios, generando la desigualdad de condiciones entre trabajadores que, a pesar de prestar el mismo servicio, no reciben la misma retribución, situación que le impide al individuo afectado, alcanzar el BUEN VIVIR. Se despejará la gran incógnita planteada: ¿El Estado Ecuatoriano garantiza el Derecho Constitucional al trabajo?; generando una propuesta de cambio que garantice, el cuidado y protección de los derechos que tiene el trabajador ecuatoriano, desde la adecuada aplicación de la normativa constitucional que deberá sufrir una “metamorfosis” para ser eficaz. The current research work is intended to demostrate affectation of the Constitucional Right to work, due to the coexistence of labor precarization since the approval of the engagement of specialized technical services authorized by the Constitutional Mandate N° 8 and Regulation. Such standard that has not eliminated precarization, wich goes against the spirit of protecting the labor relation, through the civil engagement of services, wich in turn, has generated unequal conditions among workers, who receive a different remuneration in spite of rendering the same service, in order to attain GOOD LIVING. A great doubt posed shall be answered: Does the Ecuadorian State warrant the constitutional right to work in deed?, by generating a change proposal to warranty the practice of the Ecuadorian workers’ rights, due to the adequate application of the constitutional regulatory body that should be put through a “metamorphosis” to be efficient.
