La delincuencia es una problemática difícil de abordar cuando el infractor es un joven, es
por esto que en Chile actualmente existe una preocupación por parte de todos los sectores sociales
para contribuir, mediante acciones, en la superación de esta problemática social.
El actual sistema de justicia juvenil ofrece mediante la Ley Nº 20.084, de Responsabilidad
Penal Adolescente, responsabilizar a los jóvenes por los hechos delictivos que cometan
cumpliendo sanciones por estos. Hoy, el Estado tiene la obligación de reinsertar a los menores y
que estos no vuelvan a delinquir, es decir, se debe interrumpir la relación que existe entre drogas
(consumo abusivo) y delincuencia. Esta reciprocidad se encuentra justificada en diversas
investigaciones que han constatado dicha relación, cuyos resultados han sido considerados en la
Ley Nº 20.084, quien pone a disposición una serie de herramientas que se materializan en los
centros de rehabilitación y reinserción especializados en una intervención biopsico social e
integral.
En el presente estudio se dará a conocer una investigación de carácter cualitativo –
descriptivo - transaccional, teniendo como muestra los profesionales que intervienen con los
adolescentes infractores de Ley en el centro Joven de la Corporación La Esperanza. El objetivo es
caracterizar sus opiniones acerca de los facilitadores y obstaculizadores que los profesionales
identifican al momento de intervenir con estos jóvenes (factores que contribuyen y limitan que los
jóvenes puedan ser reinsertados socialmente). Se busca mediante la información recopilada
contribuir en aquellos aspectos de la intervención que no son considerados en el momento de su
evaluación de procesos y que solo pueden ser vislumbrados en la praxis. Delinquency is a problem difficult to approach when the offender is a young. That is why
that in Chile there is now a concern for all sectors of society to contribute through actions to
overcome this social problem.
The current juvenile justice system offers, by the Law No 20.084 of Adolescent Criminal
Responsibility, to empower young people who commit punishable acts to fulfill these sanctions.
Nowadays, the State has an obligation to reintegrate these children and not return them to crime,
that is to say, to stop the relation between drugs (abuse) and delinquency. This reciprocity is
justified in various investigations that have found such a relation. The results have been considered
in the Law No 20.084 that makes available a series of tools that are materialized in specialized
rehabilitation centers and reintegration in a bio psycho social and integral intervention.
In this research a qualitative - descriptive - transactional investigation will be released,
taking as a sample the professionals involved with young law offenders in the youth center of the
Esperanza Corporation. The objective is to characterize their views about the facilitating and
hindering that professionals identify when they join in with these young (factors that contribute
and restrict that young people can be reintegrated socially). Through collected information it is
aimed to contribute to those aspects of the intervention which are not considered at the time of
its process evaluation and that can only be glimpsed in practice.
