State’s Patrimonial Responsibility in the 1999 Venezuelan Constitution

Resumen
Estudiar la responsabilidad patrimonial del Estado implica determinar si esa
unidad donde reside el poder supremo de un país, es susceptible de ser considerada
responsable por los daños y perjuicios que pueda ocasionar a los particulares por
el ejercicio de las actividades que le son propias, y en consecuencia, ser obligada a
repararlos. Esto es lo que en Derecho Privado se conoce como responsabilidad civil,
concepto que una vez extrapolado al ámbito del Derecho Público, genera la noción de
responsabilidad patrimonial -eje central de estas refl exiones-, en las cuales se aborda el
fundamento conceptual y normativo de esta fi gura en Venezuela, así como el estudio

where the supreme power of a country resides is susceptible to be considered responsible
for the damages and prejudicial consequences that it may cause to individuals by the
exercise of its inherent activities, and consequently, to be obliged to indemnify them. This
is what in Private Law it is known as civil liability, concept that once being extrapolated
to the ambit of Public Law, produces the notion of patrimonial responsibility –central
axis of these refl ections-, in which the normative and conceptual foundation of this
fi gure in Venezuela is approached, as well as the study of the constitutional regime
existing in this subject.
