A tributação vem sendo discutida em função da constante elevação da carga tributária e dos incentivos fiscais concedidos pelos governos estaduais com o intuito de atrair
investimentos privados. Desde a promulgação da Constituição Federal de 1988, que outorgou aos Estados e municípios poderes para instituir tributos, houve um aumento nos conflitos entre os entes federados em função da utilização de incentivos vinculados ao ICMS. Para que esses conflitos fossem dirimidos, surgiu o Conselho Nacional de Política Fazendária (CONFAZ) que condicionaria a existência de benefícios fiscais a convênios firmados entre os Estados e Distrito Federal. No entanto, alguns trabalhos comprovaram que a prática de concessão de incentivos ficais continuava desconsiderando a política fazendária do CONFAZ. Para tentar amenizar os efeitos da guerra fiscal e proteger seus mercados internos, os Estados editaram normas inibindo a aquisição interestadual de mercadorias com benefícios fiscais. No caso do Estado de Minas Gerais, foi publicada a Resolução 3.166/2001 que limitou o aproveitamento de crédito das operações interestaduais. O objetivo deste estudo é verificar os tipos de benefícios fiscais e creditícios concedidos pelos Estados e suas implicações na sistemática da incidência do ICMS sobre operações relativas à circulação de mercadorias para o Estado de Minas Gerais. Para tanto, fez-se necessária a descrição da sistemática da incidência tributária sobre os principais insumos e bens de capitais detentores de benefícios
fiscais nos Estados, a identificação de como esses benefícios interferem nos custos de produção e de comercialização e por fim avaliação das medidas de protecionismo implementadas e sua implicação nos setores da economia. Conclui-se que o benefício fiscal mais comum é o crédito presumido e que a Resolução 3.166/01 manteve os níveis de arrecadação do estado de Minas Gerais no mesmo patamar, mesmo crescimento do PIB a um nível inferior em relação aos demais estados. The tax has been discussed as a function of the constant increase in taxes and tax incentives granted by state governments in order to attract private investment. Since the
enactment of the Federal Constitution of 1988, which granted to states and municipalities the power to impose taxes, an increase in conflicts between federal entities for the use of
incentives linked to ICMS. For those conflicts were resolved, there was the National Policy Council (CONFAZ) that condition the existence of tax benefits to agreements signed between the states and Federal District. However, some studies have proven that the practice of granting tax incentives continued disregarding the policy of the treasury CONFAZ. To try to
mitigate the effects of the war tax and protect their domestic markets, states published rules inhibiting the acquisition of goods interstate with tax benefits. In the State of Minas Gerais, was published 3.166/2001 resolution that limited the use of credit operations interstate. The objective of this study is to determine the types of tax credit granted by States and their implications for systematic ICMS on operations on the movement of goods to the State of Minas Gerais. Therefore, it is necessary to systematic description of the tax incidence on the main inputs and capital goods holders of tax benefits in the States, to identify how these benefits affect production costs and marketing and finally evaluate the measures implemented protectionism and its implication in the industries It is concluded that the tax credit is more common than assumed and maintained Resolution 3.166/01 collection levels of the state of Minas Gerais in the same league, even GDP growth at a lower level compared to other states.
