| dc.description | El derecho penal liberal surgió como una protección de las personas contra las acciones de otros individuos.  Se trata de una protección de las libertades negativas. La definición dada por John Stuart Mill en “Sobre la  libertad” es la precursora inmediata de la filosofía del derecho penal liberal. En esta definición toda forma de  paternalismo, así como la inspección de la subjetividad moral de cualquier miembro de la comunidad se  excluye. ¿Cuál es el principio que este autor propone en esta famosa obra? Es el ‘principio del daño’. Sin  embargo, muchos autores actuales que no rechazan el principio liberal que debe presidir en el derecho  penal, han apoyado una especie de inspección subjetiva de la moralidad de los actos y los autores de ciertos  actos criminales, que termina en la noción de reproche moral. Un verdadero retorno al principio liberal de  derecho penal sería que el poder represivo del Estado solo debe ejercerse para prevenir o disuadir a otros de ser dañado. | |
| dc.description | Liberal criminal law came into being as a protection of individuals against the actions of other individuals. It  is a protection of negative freedoms. The definition given by John Stuart Mill in ‘On Liberty’ is the immediate  precursor of the philosophy of liberal criminal law. In this definition all forms of paternalism and inspection  of the moral subjectivity of any member of the community is excluded. What is the principle that Mill puts  forward in this famous work? It is the ‘Harm Principle’. However, many current authors who do not reject the liberal principle that must preside in criminal law, have supported a kind of subjective inspection of the  morality of acts and of the perpetrators of certain criminal actions, which ends in the notion of moral  reproach. A genuine return to the liberal principle of penal law would be that the repressive power of the  state must only be exercised to prevent or dissuade others from being harmed. | |
