El covid-19 como evento de fuerza mayor y caso fortuito en el cumplimiento de las obligaciones derivadas del contrato de arrendamiento de local comercial

spa: De la actual situación que se vive en todo el mundo, ocasionada por la enfermedad COVID-19 y su rápida propagación, además de la falta de precedentes decisionales para hacer frente a las situaciones creadas en el marco jurídico, nace la necesidad de trabajos investigativos que busquen las respuestas a estas situaciones creadas y con una necesidad inminente de una solución jurídica. Es por eso, que, por los medios de información, situaciones personas y de allegados, se evidenció la situación que estaban afrontando los arrendatarios de los establecimientos de comercio, que producto de las cuarentenas decretadas por el gobierno nacional, sus locales comerciales debían permanecer cerrados al público cuando estos eran el único sustento económico que ostentaban. Es por eso, estudiando la situación actual y utilizando un análisis objetivo de los presupuestos de hecho en los que se encontraban estos arrendatarios y las posibles soluciones jurídicas, evidencié un posible encausamiento hacia la materialización de los presupuesto de la teoría de la ausencia de responsabilidad, por lo que me pareció pertinente y procedente realizar un trabajo investigativo que analizara estas situaciones y diera, luego de un análisis jurídico, la posibilidad de alegar la ausencia de responsabilidad por el incumplimiento contractual. Fue necesario hacer una explicación tomando fuentes jurisprudenciales y doctrinales de la fuerza mayor y el caso fortuito, las causales de terminación del contrato de arrendamiento y su posible adecuación a las situaciones presentadas. Para terminar en un análisis de los requisitos que debían contener las situaciones puntuales en materia de la investigación para hablar de fuerza mayor y caso fortuito en el cumplimiento de las obligaciones del contrato de arrendamiento comercial eng: From the current situation that exists throughout the world, caused by the COVID-19 disease and its rapid spread, in addition to the lack of decisive precedents to deal with the situations created in the legal framework, the need for investigative work is born. look for the answers to these created situations and with an imminent need for a legal solution. That is why, through the media, situations of people and relatives, it was evidenced the situation that the tenants of the commercial establishments were facing, that as a result of the quarantines decreed by the national government, their commercial premises had to remain closed to the public when these were the only economic support they held. That is why, studying the current situation and using an objective analysis of the de facto assumptions in which these tenants were found and the possible legal solutions, I evidenced a possible prosecution towards the materialization of the assumptions of the theory of the absence of responsibility, Therefore, it seemed pertinent and appropriate to carry out an investigative work that would analyze these situations and give, after a legal analysis, the possibility of alleging the absence of responsibility for the breach of contract. It was necessary to make an explanation taking jurisprudential and doctrinal sources of force majeure and fortuitous event, the causes of termination of the lease and its possible adaptation to the situations presented.
