The paper analyzes the institute of Urban Land Regularization in Brazilian Law,
investigating the extent to which its application has made it possible to implement the
social right to adequate housing in the municipality of Santa Maria/RS from a case
study. In Brazil, with the growth of urban land use, vulnerable populations are left with
the periphery of the city as a place to live. Thus, it is not enough to provide these
groups with a place to live. It is necessary to ensure the right to adequate housing,
with basic urban infrastructure, providing essential public services, such as basic
sanitation, electricity, access to health, education and the urban center, with paving
and urban mobility. In view of this, land regularization arises with the aim of improving
the living conditions of these populations, but it is clear that many people are still not
guaranteed rights inherent to adequate housing. In Santa Maria/RS, several informal
centers have been formally inserted in the urban territory through land regularization.
In this scenario, the question is: to what extent has urban land regularization been
able to implement the social right to adequate housing in the city of Santa Maria/RS?
Therefore, the aim is, initially, to analyze urban land regularization and its relationship
with the realization of the social right to adequate housing. Still, to study land
regularization in the city of Santa Maria/RS, tracing a geographic and historical
overview of the institute in the municipality. Finally, it seeks to carry out a case study
of the land regularization of the urban centers KM3, Nova Santa Marta and Vila
Jardim. The hypothetical-deductive method of approach and the methods of historical
and monographic procedure are used, in addition to bibliographical and documental
research techniques. It is concluded that land regularization is an important instrument
for realizing the social right to adequate housing, and, in the city of Santa Maria/RS,
based on the case study carried out, it has been able to improve the quality of life of
the beneficiaries, albeit belatedly.
