Resumen
El presente trabajo de investigación tiene el objetivo de analizar la influencia de los
tratados y acuerdos internacionales ante la inconstitucionalidad del artículo 536 del
Código Orgánico Integral Penal a través del estudio de caso N° 8-20-CN/21 para
establecer la supremacía de los derechos humanos ante cualquier normativa
nacional. Por ello, el diseño de investigación reside en el método cualitativo y
exploratorio, con una metodología que se adapta a las características y necesidades
de la investigación que permite recopilar, analizar, inferir y direccionar la
investigación sobre temas pocos estudiados, abarcando diversas perspectivas
innovadoras, posibilitando como nexo la orientación pertinente para estudios
posteriores. La reforma al artículo 536 del COIP, fue el resultado de la comprobación
de la inconstitucionalidad contenida dentro de una frase de este artículo sustentado
por los argumentos de los afectados dentro de la audiencia de revocatoria de prisión
preventiva, donde se evocó la normativa internacional que fue vulnerada y la Corte
Constitucional en pleno declaró a favor dicha inconstitucionalidad. In the present research work, the required sources that were obtained through
bibliographic and documentary information will be used, which consist of the
collection of data through authors who express their thoughts in treated books and
legal magazines; and thus be able to reach the knowledge about the influence of
International Law through international treaties and conventions on the sovereignty
of States in their legal system. This research is innovative, so it will allow the
generation of technical-scientific knowledge on the subject; in addition, to direct
future researchers in the broad field of law. The objective of this research is to
analyze the influence of international treaties and agreements on the
unconstitutionality of article 356 of the Organic Comprehensive Criminal Code
through case study No. 8-20-CN/21 to establish the supremacy of human rights
before any national regulations. For this reason, the research design resides in the
qualitative and exploratory method, a methodology that adapts to the characteristics
and needs of the research that will allow collecting, analyzing, inferring and directing
the research on little studied topics, encompassing various innovative perspectives,
allowing as nexus relevant guidance for further study.
